How is this legal? Under the 1974 Real Estate Settlement and Procedures Act, known generally as RESPA, Realtors are not allowed to collect fees, known as kickbacks, for referring business to a settlement service provider.
In 1996, however, HUD agreed that Realtors could be compensated for loan origination services by lenders if certain conditions were met.
Today, it's possible for Realtors to earn compensation when they provide something of value, such as processing services, assuming they reasonably reflect the value of what the Realtor contributes to the lending process.
HUD has described different ways that a Realtor can provide services for a loan that would qualify them to legally earn compensation. Our program is specifically designed to comply with HUD and RESPA’s requirements, and allow the Realtors to perform a handful of these services, a lot of which they are likely already doing.
The basic rules for Realtors who want to participate in our program look like this:
We work with each one of our Realtor Affiliates to make sure they understand the law and comply with all of the necessary requirements, which is not difficult. It only takes 1-2 hours to enroll in the program and complete your training, and then you can be on your way to earning additional income immediately.
